What is subletting?

When a tenant cannot fulfill the terms of a rental contract (lease) the tenant has the option to sublet (or sublease) the rental unit. Subletting often requires the landlord’s approval as explained in the original lease. In such cases, a sub-tenant would replace the original tenant for a specific duration. In a subletting arrangement the original tenant is rarely released from the original contract, and he/she still assumes responsibility for the rental unit. A well written sublease contract helps the sub-tenant understand his/her responsibilities and can protect the original and subtenant(s) from unnecessary risk. 

Things to keep in mind 

  • remain flexible 

  • prepare to negotiate the terms of the sublease 

  • develop a formal written agreement
